Yes, they do go in from different ports. Most FTP'ing takes place on 21. But, how can they target you if you're not sharing any files? They are searching for copyrighted songs. So if they search, and you aren't sharing, then how will they know you have that file? They won't ever see your username because of the fact it doesn't come up when they do a search. Now if you have been downloading like crazy and they are keeping logs of certain file transactions, then they could get you that way, but from the articles that I have read they are just doing routine searches and targeting large sharers.

I agree with you about this lawsuit thing waiting to happen, but you should know that when you're hardrive writes a file, it is there forever. Even if you "delete" your file, or format your harddrive, the file is still written. This is how they catch most internet kiddie porn freaks who try deleting files and formatting, doesn't work.
